Contracting in México
A common concern of people coming to México for the first time has to do with how do you contract for construction, since this is a different country, with a different culture and a totally different legal system.
Aside from the fact that every major law firm in México is fully capable and experienced in this area and most likely, has boiler plate construction agreement formats ready to go, the truth of the matter is that construction contracting and support documentation is a lot simpler in México than it is in the United States.
But a fact to consider is that design build, the project delivery system that is now in fashion in the United States, and throughout the world, has been used by foreign companies in México for the last thirty years, and for a very simple reason; as manufacturing companies came to México to build plants, they contracted a builder, usually before they had drawings and specifications that complied with Mexican code, so the same builder had to develop final prints and specs for the project and then proceed to construct the facility.
With time, Mexican builders took an ever-growing role in design and it just became simpler for the client to contract the entire design and construction work with one single source.
